General Directorate of Mining
The General Directorate of Mining (DGM, for its acronym in Spanish) is the Line Unit of the Ministry of Energy and Mines, which reports directly to the Office of the Vice Minister of Mines, which is responsible for regulating and promoting mining activities, safeguarding the rational use of mining resources in harmony with the environment. The DGM is currently under the responsibility of Eng. Alfredo Rodriguez Muñoz.
According to Article 98 of Supreme Decree 031-2007-EM, the General Directorate of Mining has the following functions and attributions:
- Propose the policy of the Mining Sector in accordance withsector and national development policies;
- Participate in the preparation and evaluation of the Referential Mining Plan and the Mining Development Sector Plan;
- Promote investments in the Mining Sector;
- Formulate and propose the technical and legal standards related to the Mining Sector, promoting sustainable development and technology;
- Evaluate the technical, economic and financial information related to the Mining Sector and manage the Mining Information System;
- Coordinate with the General Directorate of Mining Environmental Affairs, INGEMMET, OSINERGMIN, as well as with the Regional Governments, Local Governments and other public and private entities, the matters related to the development of sustainable activities of the Mining Sector;
- Grant the concession titles of benefit, overall work and mining transport, as well as approve their amendments and authorize the construction of access, ventilation and drainage works in neighboring mining concessions;
- Manage and distribute the right of validity and penalty;
- Authorize the start or restart of metallurgical mining activities;
- Grant the Mining Operation Certificates and Authorize the use of ANFO and similar, under their jurisdiction;
- Approve mining plans and their amendments under their jurisdiction;
- Authorize the registrations in the Registry of Specialized Companies of Mining Contractors;
- Resolve illegal extraction procedures under their jurisdiction;
- Issue an opinion on requests for mining easement;
- Approve the Investment Programs and Feasibility Studies for the Agreements of Guarantees and Investment Promotion Measures as well as their amendments and executions; e.g., approve Investment Programs in Exploration, its amendments and executions, as well as sign investment agreements in exploration for the return of the Tax on General Sales (IGV) and the Municipal Promotion Tax (IPM);
- Qualify the Reinvestment Programs charged to Non-distributed Profits;
- Issue an opinion for the acquisition of mining properties and investments by foreigners in the border area; approve the list of mining experts and impose sanctions on them in case of non-compliance with the governing regulations;
- Resolve the economic and financial aspects of the mine closure plan and closure plan for mining environmental liabilities;
- Grant certificates of progressive and final compliance of the mine closure plan and mining environmental liabilities;
- Prepare, update and prioritize the inventory of mining environmental liabilities and identify the responsible parties for the liabilities;
- Approve the list of persons not able to make mining petitions, having as reference the approval of the execution of the environmental liabilities closure;
- Provide verification visits in areas where mining activities are carried out;
- Grantappeals and declare nullity; as well as resolve administrative resources under its jurisdiction;
- Impose sanctions in matters under their jurisdiction;
- Issue directorial resolutions in the scope of the Mining Sector;
- Perform all other functions under its responsibility.
